RATIONALE:
POLICY: The Oakland University Board of Trustees approved the following smoking policy on June 3, 1993. This policy supersedes the policy of January 14, 1987.
I. Introduction
This policy is established to promote public health and to provide for Oakland University's compliance with the Michigan Indoor Clean Air Act (P.A. 1986, No. 84, MCLA 333.12601 et.seq.); P.A. 368 of 1978 as amended, MCLA 333.12905, concerning eating establishments; and Sec. 20 of P.A. 227 of 1967, MCLA 408.820, concerning elevators.
II. Definitions
A. "Smoking" means carrying a lighted cigar, cigarette, pipe or other lighted smoking device.
B. "Private residences" means houses or apartments under the university's control or leased to others by the university, Meadow Brook Hall housing, and residence hall rooms when designated by the President.
III. Prohibition
Smoking is prohibited in all enclosed areas of the Oakland University campus except in:
A. Private residences; and
B. Spaces specifically designated by the President or designee for such purposes as special or private functions, research, or performance where smoking is part of the performance. In the case of special or private functions, at least one-half of the room used for the function shall be reserved and posted as a nonsmoking area. In determining such reservation, the nonsmoking area shall be located closest to the source of fresh air and special consideration shall be given to individuals with a hypersensitivity to tobacco smoke.
IV. Posting
A. Signs shall be posted according to law and following the guidelines of the Michigan Department of Public Health.
V. Enforcement
The success of this policy will depend upon the thoughtfulness, consideration, and cooperation of smokers and nonsmokers. All employees share in the responsibility for adhering to and enforcing this policy.
A. Complaints involving smoking by a student may be made to the supervisor of the area or activity in which the alleged violation occurred or to the Dean of Students.
B. Complaints involving smoking by staff should be made to the staff member's supervisor.
C. The supervisor or the Dean of Students will investigate and take any needed action to resolve the issue.
D. Persons violating this policy will be subject to discipline as with other violations of university policies, regulations, and rules. State law also provides for a civil fine of not more than $100 for a first violation and a fine of no more than $500 for a second or subsequent violation of the Michigan Indoor Clean Air Act (MCLA 333.12601 et. seq.).
